1. Agreement

These Terms govern use of the Theoretical Height Max iOS application and its backend services (the "Service"), operated by SHIRO KAWAI(川井志朗) ("we"). By using the Service you agree to these Terms and to the Privacy Policy.

2. The Service is wellness, not medical care

The Service records children's growth and shows a transparent, deterministic estimated range for adult height based on published formulas and WHO growth references. You acknowledge that:

• Estimates are ranges, not guarantees. Actual adult height may fall outside any displayed range.
• The Service does not diagnose, treat, or prevent any condition, does not measure bone age or pubertal stage, and is not a substitute for a pediatrician or other qualified clinician.
• Habit suggestions support general healthy routines; they do not and cannot increase a child's height beyond biological potential.
• Any "talk to a clinician" notice is a neutral screening suggestion, not a diagnosis; absence of such a notice is not an assurance of health.

3. Eligibility and guardian responsibility

You must be an adult parent or legal guardian to create an account or enter a child's data, and you confirm you are authorized to provide the child's information. You are responsible for the accuracy of entered data and for decisions made about your family; when in doubt about a child's growth or health, consult a clinician.

4. Accounts and local-only mode

The Service works in a local-only mode without an account; you are then responsible for device backups. With an account (email/password), data (excluding photos) syncs to our servers as described in the Privacy Policy. You are responsible for maintaining the security of your device and Apple account.

5. Subscriptions and billing

• Premium features (including the numeric adult-height estimate and the full habit program) require an auto-renewable subscription: monthly or annual, in the "Premium" subscription group, billed via your Apple account at the price shown before purchase.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, via iOS Settings → Apple Account → Subscriptions. Apple's payment terms apply; refunds are handled by Apple under its policies.
• Restore Purchases is available on the paywall and in the Family tab.
• Non-subscribers can still record and retain measurements, view non-numeric growth history, restore purchases, export data, and delete data or the account.

6. Acceptable use

You may not: use the Service for anyone whose data you are not authorized to manage; attempt to access other users' data; reverse engineer, probe, or disrupt the backend; misrepresent Service outputs as medical assessments; or use the Service to shame, rank, or pressure a child.

7. Intellectual property

The Service, including its design, code, and content, is owned by SHIRO KAWAI(川井志朗) or its licensors. Your data remains yours; you grant us only the license needed to operate the Service (storage, sync, export) as described in the Privacy Policy. WHO reference data is used under WHO's public-use publication of its growth tables.

8. Termination and deletion

You may stop using the Service and delete your account (and all server data) at any time in-app. We may suspend or terminate access for material breach of these Terms, with notice where practicable. Sections 2, 9, and 10 survive termination.

9. Disclaimers and liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND ACCURACY OF ESTIMATES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW (INCLUDING MANDATORY CONSUMER PROTECTIONS). Apple is not a party to these Terms and does not endorse any estimate produced by the Service.

10. Governing law; changes

These Terms are governed by governing law, with venue in venue, subject to mandatory consumer-law rules of your residence. We may amend these Terms; material changes will be announced in-app before taking effect.

本規約は、運営者名(以下「当社」)が提供する iOS アプリ 「理論身長マックス」および関連バックエンド(以下「本サービス」)の 利用条件を定めるものです。本サービスの利用により、本規約および プライバシーポリシーに同意したものとみなされます。

2. 本サービスはウェルネスであり医療ではありません

本サービスは、お子さまの成長記録と、公表された計算式および WHO 成長基準に 基づく透明で決定的な成人身長の推定レンジを提供します。利用者は以下を 了承するものとします。

• 推定はあくまで幅を持つ目安であり、保証ではありません。実際の成人身長が 表示レンジの外になることがあります。
• 本サービスは診断・治療・予防を行わず、骨年齢や思春期段階の評価も行わず、 小児科医等の専門家の代わりにはなりません。
• 習慣の提案は健康的な生活リズムを支えるものであり、生物学的な可能性を 超えて身長を伸ばすものではありません。
• 「受診をご検討ください」等の表示は中立的なスクリーニング上の提案であり、 診断ではありません。表示がないことは健康の保証ではありません。

3. 利用資格と保護者の責任

アカウントの作成およびお子さまの情報の入力は、成人の親権者・保護者に 限られます。入力データの正確性および家族に関する判断は保護者の責任と なります。成長や健康に不安がある場合は医療機関にご相談ください。

4. アカウントとローカルのみモード

本サービスはアカウントなしのローカルのみモードで利用できます。この場合、 端末のバックアップは利用者の責任となります。アカウント(メールアドレス/パスワード)を利用 した場合、写真を除くデータがプライバシーポリシーの定めに従いサーバーに 同期されます。端末および Apple アカウントの安全管理は利用者の責任です。

5. サブスクリプションと課金

• プレミアム機能(成人身長の数値推定、習慣プログラム全体を含む)には、 自動更新サブスクリプション(月額または年額、「プレミアム」グループ)が 必要です。購入前に表示される価格で Apple アカウントに課金されます。
• 購読は、現行期間終了の24時間前までに解約しない限り自動更新されます。 解約は iOS「設定」→ Apple Account →「サブスクリプション」から行えます。 支払い・返金は Apple の規定に従います。
• 「購入を復元」はペイウォールおよびファミリータブから利用できます。
• 未購読でも、測定の記録・保持、数値以外の成長履歴の閲覧、購入の復元、 データの書き出し・削除、アカウント削除は利用できます。

6. 禁止事項

権限のない他者のデータの管理、他の利用者のデータへのアクセスの試み、 バックエンドの解析・妨害、本サービスの出力を医学的評価と偽ること、 お子さまを辱め・順位付け・圧迫する目的での利用を禁止します。

7. 知的財産権

本サービス(デザイン・コード・コンテンツを含む)は当社またはライセンサーに 帰属します。利用者のデータは利用者に帰属し、当社はサービス運営(保存・ 同期・書き出し)に必要な範囲でのみ利用します。WHO 基準データは WHO が 公開利用のために公表しているものを使用しています。

8. 終了と削除

利用者はいつでも利用を停止し、アプリ内でアカウント(およびサーバー上の 全データ)を削除できます。当社は、本規約への重大な違反があった場合、 可能な限り通知の上で利用を停止することがあります。第2条・第9条・第10条は 終了後も効力を有します。

9. 免責と責任の制限

本サービスは現状有姿で提供され、推定の正確性を含む明示・黙示の保証を 行いません。法令の許す最大限の範囲で、当社の責任は請求前12か月間に 利用者が本サービスに支払った額を上限とします。ただし、消費者契約法その他の 強行法規により制限できない責任はこの限りではありません。Apple は本規約の 当事者ではなく、本サービスの推定結果を保証するものではありません。

10. 準拠法・変更

本規約は 準拠法 に準拠し、管轄裁判所 を専属的 合意管轄とします(利用者の居住地の強行法規が優先する場合を除く)。 重要な変更は施行前にアプリ内で告知します。
